Dedicated Asset Valuation Attorney in La Grange, KY

A house has a price tag. A business, a pension, or a piece of rental property does not. In a divorce, that difference decides how much you walk away with. You need every asset you and your spouse built valued fairly. Not at whatever number one side wants the court to accept.

The Assets a La Grange Asset Valuation Attorney Values in Divorce

Some marital assets sell for close to what the market says they are worth. A house or a car is easy to price. Others need real analysis before anyone can put an honest number on them.

Our asset valuation lawyers in La Grange can help value and negotiate:

  • Business interests and professional practices
  • Retirement accounts, pensions, and 401(k)s
  • Investment and rental real estate
  • Stock options and deferred compensation
  • Collections, jewelry, and other high-value personal property

Each one calls for its own approach, and undervaluing even one of them can significantly change what you walk away with. When a business or pension needs a professional appraisal, we bring in the right expert and use their findings to negotiate or litigate for a fair number.

We also review the other spouse’s disclosures line by line, so an asset does not get left off the list without anyone noticing.

What Happens When Assets Aren’t Valued Correctly Under Kentucky Law

Kentucky divides marital property under KRS 403.190, and the court does not have to split everything 50-50. It divides property in what it considers fair proportions, based on what each spouse contributed and what each one needs going forward.

If a business gets valued too low, or a pension gets left out of the numbers entirely, that unfairness is very hard to undo once the judge signs the final order. Kentucky law treats property division as final in almost all cases. A narrow exception exists if you can later prove the other spouse committed fraud, such as knowingly hiding or lying about an asset’s value.

A family business, a rental property, or years of retirement savings all need a real, objective analysis, not just a number that sounds reasonable. A rough estimate can end up costing you a fair share of the marital estate.

What Happens When You Suspect Your Spouse Is Hiding or Undervaluing Assets?

Sometimes the real fight is not how to split an asset. It is finding it in the first place. A spouse who wants to keep more than a fair share might undervalue a business, delay a bonus until after the divorce is final, or move money into an account you do not know about. None of this is unusual, and Kentucky courts have tools to address it once it is uncovered.

We look for the signs: income that dropped right before the filing, a business valuation that does not match years of tax returns, or accounts that used to show up on statements and suddenly do not. When something does not add up, we can request financial discovery, subpoena records, and bring in a forensic accountant to trace where the money went. These steps take time, but they can move a settlement offer in your favor once the real numbers come out.

You do not have to prove fraud on your own. Our trusted La Grange asset valuation lawyers can help.

Asset Valuation Lawyer FAQs for La Grange, KY

How much does it cost to value a business or retirement account in my divorce?

The cost depends on the asset. A retirement account often needs a certified plan specialist, while a business may need a forensic accountant. Some of these costs are shared by both spouses under the divorce order itself. We can estimate the full cost at your first meeting once we know what is involved in your case.

Do I need a lawyer if my spouse and I already agree on the value of our assets?

Even an agreed number should be reviewed before you sign. We check that nothing was left out and that the agreement holds up if either of you later disputes it.

What happens if the court finds my spouse undervalued an asset?

If this is discovered before the divorce is final, the court can order a new appraisal or adjust the division before signing off. If it’s discovered after the divorce is final, you generally have to file a motion asking the court to reopen the case, and you’ll need to show the other spouse committed fraud. Courts don’t reopen a case just because a number turns out to be wrong, and they usually require proof that the other spouse knew and hid it.

Does the Oldham County Family Court require an independent appraisal for a business or retirement account?

The court does not automatically order one, but a judge is far more likely to accept a number backed by a licensed appraiser than a figure either spouse simply states. We handle asset valuation cases in the Oldham County Family Court and know what documentation carries weight there.

Is a 401(k) or pension split in a Kentucky divorce?

Yes, if it was earned during the marriage. Dividing it without triggering an early withdrawal penalty usually requires a separate court order called a QDRO.

What if only part of an asset was built during the marriage?

We trace the portion that grew during the marriage from the portion that existed before it. Only the marital share gets divided, and getting that split right can change your final number by a large margin.
